Temporary agency work is only possible in situations determined by law. It concerns the following motives:

- [Execution of an exceptional work ](https://werk.belgie.be/nl/themas/arbeidsovereenkomsten/uitzendarbeid/uitvoering-van-een-uitzonderlijk-werk)
- [Supply of a temporary worker to a user with a view to permanent recruitment (= inflow) ](https://werk.belgie.be/nl/themas/arbeidsovereenkomsten/uitzendarbeid/terbeschikkingstelling-van-een-uitzendkracht-aan-een)
- [Providing artistic services and/or producing artistic works for the benefit of an occasional employer or user](https://werk.belgie.be/nl/themas/arbeidsovereenkomsten/uitzendarbeid/artistieke-prestaties-artistieke-werken-voor-een)

If, as an employer, you invoke temporary unemployment for economic reasons or because of bad weather conditions, you cannot replace your permanent employees with temporary workers.

In certain other circumstances (e.g. temporary unemployment due to force majeure) temporary workers may be called upon and as an employer you must ensure that you respect the motives of temporary work. For example: in the case of temporary unemployment due to force majeure of a permanent employee, who is not sick himself but has to stay at home because of compulsory quarantine, you could call on a temporary employee to continue his work.
